Terms and Conditions for Participation in the Tests

These General Conditions of Participation apply to the MERRELL shoe tests (the "Shoe Tests"). By taking part in a Shoe Test, the participant (the "Participant" or "You") agrees to these General Conditions of Participation (the "GCP") in their entirety. Please read these GCP carefully before participating in any Shoe Test. If you do not agree to the GCP, you will not be able to participate in the Shoe Test.

The Shoe Test is organized by Outdoor Perspectives SARL, a company under French law with its registered office at 1 Impasse des Marais - Bâtiment Altitude 2, PAE Les Glaisins, 74940 Annecy (the "Organizer"). The Organizer acts on behalf of various brands, including MERRELL.

  1. The information provided by the Participant in the test or registration forms must be accurate and complete.
  2. The Shoe Test is open to individuals aged 14 and over. If the Participant is under 18, they may only participate in the Shoe Test with the consent of their legal representatives. To provide consent, legal representatives must present valid identification.
  3. Before accepting the Shoe Test, the Participant must provide, as a guarantee, an official photo ID (identity card, driver's license, etc.) or any other deposit, which will be returned after the tested product has been duly returned. The Organizer will make a copy of the Participant's official photo ID for identification purposes during the Shoe Test.
  4. The trial shoes will be provided to the Participant for testing purposes. The trial shoes provided on loan will be used at your own risk. The Participant will adjust their behavior according to their level. The Participant will refrain from running if they are tired or under the influence of alcohol or medication. Additionally, the Participant will take into account warnings present in the running area and familiarize themselves with the terrain and any potential obstacles.
  5. The Participant confirms that the trial shoes were in intact, suitable, and usable condition when accepted. The Participant agrees to handle the shoes with care and to repair any damage or loss caused. The shoes may only be used in the locations designated for the event.
  6. If the trial shoes are not functional, the Participant will return them immediately.
  7. The Participant must return the trial shoes immediately upon request. Otherwise, the Participant agrees to return the trial shoes no later than the return deadline specified in the test form.
  8. The Participant may not under any circumstances give the trial shoes to a third party. If the Participant gives the trial shoes to a third party, they will be responsible for any damage (even incidental) that would not have occurred if the borrower had kept the trial shoes.
  9. Liability

The Participant acknowledges that running involves dangers and may result in BODILY INJURY or DEATH.

The Participant voluntarily agrees to accept all risks of death and bodily injury that may arise from such sports activity or from participating in the Shoe Test in any way.

THE PARTICIPANT AGREES TO TAKE ALL NECESSARY PRECAUTIONS TO AVOID PLACING THEMSELVES OR OTHERS IN SITUATIONS THAT MAY COMPROMISE THEIR SAFETY OR THAT OF THIRD PARTIES. IN THIS CONTEXT, THE PARTICIPANT SPECIFICALLY AGREES TO:

  • WEAR PROTECTIVE EQUIPMENT,
  • COMPLY WITH ALL SAFETY RULES THAT MAY APPLY TO THE PRACTICE OR ENVIRONMENT.

Furthermore, the Participant agrees to follow the instructions given by the Organizer during the Shoe Test.

In light of the above, You agree to indemnify and hold harmless the owners, manufacturers, service providers, and retailers of the equipment provided for the test, as well as all agents and indirect representatives, legal representatives, and legal successors (hereinafter referred to as the "Suppliers"), in the event of bodily injury, death, financial loss, or other damage arising from your participation in the test and/or use of the test products. This liability waiver does not apply if the Suppliers commit intentional or gross misconduct, or for any damages arising from an infringement of life, bodily integrity, or health resulting from a serious violation of the Suppliers’ obligations. The above limitation of liability does not apply in cases of mandatory legal liability (including, but not limited to, liability under applicable product liability laws).

10.The Participant is advised to have adequate insurance coverage, including personal coverage (such as medical expenses, disability benefits or capital, repatriation, hospital expenses, etc.), repatriation insurance (if applicable), and third-party liability insurance.

11. Confidentiality

Personal data is controlled by the Organizer. The Organizer’s privacy policy for its partner is available at: https://www.merrell.com/FR/fr_FR/content?caid=privacy-policy (the "Privacy Policy").

By participating in the Shoe Test, you agree to the Privacy Policy and consent to all personal data, including but not limited to the Participant's name, address, copy of ID, photo, copy of signature, etc., provided as part of the Shoe Test being recorded and processed by the Organizer and/or any third party acting on its behalf. Personal data will be processed for the management of the Shoe Test and may be shared with third parties as necessary for the organization of the Shoe Test.

With your consent, the Organizer may also use your personal data to send you information and promotional offers via email, SMS, or other forms of digital messaging. If personal data is shared with third parties outside the EEA, the Organizer will ensure that adequate data protection measures are in place, in accordance with applicable binding data protection laws.

Requests related to the processing of personal data, including any withdrawal of consent, requests for information regarding stored data, and requests for correction or deletion of personal data, can be sent to the following email address: hello@outdoor-perspectives.fr

12. Miscellaneous Provisions

To the fullest extent permitted by binding applicable law, these GCP will be governed by French law.

13.Image Rights

By participating in the Shoe Test, the Participant agrees and authorizes the Organizer, as well as its partners and affiliates, to capture, record, and use photographs, videos, or any other audio-visual recordings made during the event.

The Participant consents to these images and recordings being used for promotional, advertising, or commercial purposes, on any medium, for any duration, without geographical restrictions and without financial compensation.

This authorization includes the right for the Organizer and its partners to edit, adapt, modify, or reproduce these images and recordings, in whole or in part, while respecting the dignity and integrity of the Participant.

The Participant acknowledges that they will not claim any rights, title, or interest in these images and recordings, nor demand any remuneration or compensation for their use.

In case of disagreement with this clause, the Participant is requested not to participate in the Shoe Test or to contact the Organizer in advance to express their objection.
